Privacy Policy
This Privacy Policy explains how Ocean Delta Management Pty Ltd (ACN 623 086 895) as trustee for The Ocean Delta Management Unit Trust (ABN 71 976 094 089) (“OceanDelta”, “we”, “us”, “our”) collects, uses, stores and discloses personal information. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
1. What personal information we collect
We may collect: - your name, email address and phone number; - billing details and order history for purchases made on our website; - information you give us in enquiries, booking forms, strategy calls or correspondence, such as your property goals, budget, preferred locations and timeframes; - if you engage us for buyer’s agency or other services, the identification and other information we are required to collect by law, including under the Property and Stock Agents Act 2002 (NSW) and anti-money-laundering laws; and - technical information when you visit our website, such as your IP address, browser type, pages visited and cookies.
We do not collect or store full credit card details. Payments are processed by our third-party payment providers.
2. How we collect it
We collect personal information directly from you when you: - buy a product or complete checkout on our website; - book a call, fill in a form or subscribe to updates; - email, phone or message us, or meet with us; or - engage us for services.
We may also collect information from third parties with your consent, or where the law allows, such as from agents, solicitors, brokers or identity-verification providers involved in a transaction.
3. Why we collect and use it
We use personal information to: - process your order, deliver digital products and issue tax invoices; - respond to enquiries and provide the services you ask for; - manage bookings and strategy calls; - meet our legal, regulatory, tax and record-keeping obligations; - improve our website, products and services; and - send you information about our products, services, events and promotions (see section 5).
4. Who we disclose it to
We may disclose personal information to: - service providers who help us run our business, including our website and e-commerce platform (Wix), payment processors (such as Stripe and PayPal), email, accounting and cloud-storage providers; - professional advisers, such as accountants and solicitors; - parties to a property transaction you have engaged us to act on, such as selling agents, solicitors and conveyancers, where needed to provide that service; and - government agencies, regulators or law-enforcement bodies where required or authorised by law.
We do not sell or rent your personal information.
Overseas disclosure: some of our service providers, including Wix, Stripe and PayPal, may store or process information outside Australia, including in the United States and Europe. We take reasonable steps to make sure these providers handle personal information appropriately.
5. Marketing communications
If you buy from us, book a call or subscribe, we may send you emails about our products, services, case studies and promotions. Every marketing email includes an unsubscribe link, and you can also opt out at any time by emailing terry.cui@OceanDelta.com.au. Opting out of marketing does not stop order-related or service-related messages.
6. Cookies and website analytics
Our website uses cookies and similar technology, provided by our website platform and analytics tools, to operate the site, remember your preferences and understand how visitors use it. You can disable cookies in your browser settings, but some parts of the site, including checkout, may then not work properly.
7. Storage and security
We store personal information electronically with reputable cloud providers and take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. No online transmission or storage is completely secure. When personal information is no longer needed, and we are not required by law to keep it, we take reasonable steps to destroy or de-identify it.
8. Case studies and client confidentiality
We do not name clients, owners, tenants or other individuals in our case studies or marketing material without their consent. Paid case studies may include a completed project’s property address and publicly available purchase and sale information.
9. Access and correction
You can ask to access or correct the personal information we hold about you by emailing terry.cui@OceanDelta.com.au. We will respond within a reasonable time, usually within 30 days. In limited circumstances permitted by law, we may refuse access, and if so we will tell you why.
10. Complaints
If you have a concern about how we have handled your personal information, please email terry.cui@OceanDelta.com.au with the details. We will look into it and respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
11. Changes to this policy
We may update this Privacy Policy from time to time. The current version will always be published on our website with its “Last updated” date.
